don’t say Cloud Computing, you might get in trouble

patents and now copyrighst! yikes! o_O

thanks to DreamWalker, who sent me the link, we may get to the point that we can’t use the term “Cloud Computing” because Dell is trying to copyright it

this is like when Nintendo was applying for copyrights to phrases like

It’s on like Donkey Kong!

so if you were thinking of using the words “Cloud Computing” in a domain name or as a name for your service, better think twice! =(

oh well, there goes yet another way to stifle creativity!

Dell's coming! hurry, take down all the clouds!

  1. a long time ago autodesk was trying to trademark “cyberspace”. that was unsuccessful of course. in dell case, they are going up against some heavy weights. dell was built by ibm hardware and microsoft software. but a company can get too big and some person get the idea to keep an idea for themselves.

but it doesnt matter anyway. someone will come up with another word/phrase anyway. or the technology will go away replaced by another one.

remember minix? few people do. but minix grew into something else: http://en.wikipedia.org/wiki/Linux

  6. I guess Fluffy Logic is too RL.

I wonder if there’s a Digital Dewpoint. If so, when it’s reached, do we get Computing Condensation? What happens when those Computing Clouds run up against Usage Peaks? Does it rain Bits or Bytes? Are we on our way to creating a whole system of virtual weather? AthlonStorms? Heuri-canes?

  11. You *did* notice the article is 3 years old, didn’t you – published 4th August 2008…

Also, Agam Shah completely mangled “copyright” and “Trademark” – the two are not the same, yet he uses both interchangeably in the article heading & strapline.

  12. 2008? I know a patent takes 4 to 5 years, but how long does a copyright application take?

Maybe I’ll move to an Adobe hut and sit by the Corel sea

  13. And apparently Apple is suing Google’s Android manufacturers (HTC & Samsung) over phone patents.

    Excerpt (08 August 2011):

“Some patents are arguably ridiculous, too; for example, Apple has a patent for being able to call numbers cited in emails. All of the chaos and preceived absurdity of patent law is on display in the recent litgation over Google Android. And it’s just getting started.”

    Read the Article:
    http://www.pcmag.com/article2/0,2817,2390536,00.asp

In a flip-flop earlier this year, Apple was sued over their phones:
    http://www.loopinsight.com/2011/03/21/apple-rim-motorola-sued-for-patent-infringement/

And back in July, Samsung tried to patent a transparent PIXEL:

    http://image-sensors-world.blogspot.com/2011/07/samsung-applies-for-transparent-pixel.html

PS: yes, the Dell/cloud patent attempt was a couple years back… and Dell lost! Apple has lost a few patent attempts as well, but they keep trying to patent every particle in the universe. I’m waiting for them to file for a patent on the iAir that we breathe.

Wanna waste a few hours? Google “silly patents”

Or skip straight to the one from 1965 that patents “facilitating the birth of a child with centrifugal force:

  14. Ya know, Nintendo just patented the concept “Massively Single-player” as if the concept didn’t already exist to some degree… but still – seriously.

  18. The American constitution should be changed in this modern age. The founding fathers wrote “Life, liberty and the pursuit of happiness”

Now it should read, “Life, Monopoly and the pursuit of patents”
